Trademark Nerd summarise Tool’s legal plight

It was reported several months ago that Tool were facing a legal battle related with Cam De Leon‘s work with the band, and the insurance associated with that legal action. Legal documents were found, and discussed both here and other forums online. For some the legalese used was a little overwhelming and it wasn’t necessarily clear what was actually going on.

Trademark Nerd have created for us a summary of the legal case in language that is a little easier for the typical Tool fan to understand. Not to say that you guys are stupid or anything…

Anyway, the legal action will be unfolding in the coming months, and hopefully out the way early next year. Hopefully in the meantime the members of Tool can take advantage of the time prior to the holidays to nail down a few more tracks on their coming album!

you don’t really need to be a lawyer. if you’ve got a job, house, and insurance policy you have the basic framework of understanding

it really isn’t rocket science. I still call BS…. it’s sad to say but I view them as self indulgent rock stars now. with a boatload of excuses. I work in commercial insurance. these types
of lawsuits are common.

In the context of everything else the band members have been involved in since the release of 10kdays, this makes an awful lot of sense. i.e. Getting older, health issues, relationships ending/beginning, newborns, side projects… meanwhile touring no doubt not only to fund litigation but to also have an income. Seems they are simply adhering to their own standard of writing music on their own terms for themselves, not releasing it until they are fully satisfied with the product. I was just reading up on Necrophagist, a technical death metal band, yesterday and they haven’t released an album in 9 years. It’s not surprising, but their fans act the same way Tool fans do. Some are content to just sit out the wait, others are hopping ship.

Anyways, my point is that we should totally combine forces. It’d be nice to listen to someone complain about a band other than Tool for once.

Go visit any “fan” forum/message board- people bitch about shit all the time. If it makes anyone feel better (and I’m sure it won’t) at least Tool fans have something legitimate to gripe about. Granted it’s taken to an extreme level at times but years of no new album will do that.

I was in a band when I was younger. We paid some friends to design flyers and album artwork. Years later, as my band got more successful, we kept using the same friends to design artwork for us. Have to say, as much as I absolutely love the band, retiring would be better than continuing to tour on a CD that is 8-9 (or more) years old. Not that they’re actually touring on 10K Days anymore, we know now it’s to make money and, of course, because “they love to tour.” None of us have a vote, but at least one of them should push for a band mandate that they just cannot tour anymore without something new to play (besides interludes that will eventually become songs). hey cool band… don’t forget about the prior lawsuit with your label who first signed you when you couldn’t get arrested. I see a pattern of arrogance with all those suits. you don’t see rage against machine embroiled in these shenanigans. they just called it a day.. also rage was the better band.

This is utterly retarded I hate corporate bullshit and the way it tries to ruin all that is good in this world (seriously). I hope they at least manage to draw some influence from this and we get another masterpiece in the series of: Hooker with A Penis, Tick and Leeches, The Pot.

Completely agree. I’ve said it before and I’ll say it again. One guy in the band has managed to be extremely productive during that time period and 3 have not. Maynard is in 2 other bands and started a vineyard and winery – hands on too, not just the financial backer. Danny has Volto and seems to get out and play at the Baked Potato so at least he has done a little but what have Adam and Justin accomplished over 8 years?
